Any Entry which Contest Administrator or Sponsor, in its sole opinion, deems to be inappropriate for publication will not be considered or displayed, and the corresponding entrant will be disqualified from any further participation in the Contest and from any consideration to potentially receive a prize in the Contest. An Entry cannot: (i) be sexually explicit or suggestive, be unnecessarily violent, be derogatory of any ethnic, racial, gender, religious, professional or age group, be profane or pornographic, or contain any nudity or materially dangerous activity; (ii) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (iii) be obscene or offensive, or endorse any form of hate or hate group; (iv) defame, misrepresent or contain disparaging or denigrative remarks about Sponsor or its products, or about any other people, products or companies; (v) contain trademarks, service marks, design marks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind, without express advance written permission (in each instance), or contain any personal identification, such as license plate numbers, personal names, e-mail addresses, or street addresses; (vi) contain copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art, or images published on or in websites, television, movies or other media); (vii) contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without express advance written permission (in each instance); (viii) communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and (ix) depict any violation of the law, or itself be in violation of any law. By submitting an Entry, each entrant represents and warrants that: (A) the Entry is the sole and original creation of the entrant and has not been copied in whole or in part from any other work; (B) the Entry does not violate, infringe or misappropriate any copyright, trademark/tradename, service mark, design mark, or other intellectual property or proprietary right of any person (including, but not limited to, rights of privacy or publicity) or entity, and the Entry does not portray any person or entity in a false light; (C) the Entry is the sole and exclusive property of the entrant; (D) the persons depicted in the Entry have each given explicit written consent to (I) the submission of the Entry into the Contest and (II) the use of the Entry in the manner contemplated by these Official Rules; (E) the Entry has not been previously published in any medium or form; (F) the entrant owns, or otherwise possesses the rights to use, all elements of the Entry; (G) the entrant is the parent or legal guardian of all persons under the age of majority (i.e., in their resident state) who appear in the Entry (other than the entrant, if applicable); (H) the Entry has not previously received any awards, honors or recognitions; and (I) publication of the Entry via various media, including Web posting, will not violate or infringe on the rights of any third party. Each Entrant will defend, indemnify, and hold harmless Sponsor and the Promotion Parties from and against any and all claims of infringement in connection with any of his/her Entries.

If a Contest entrant shares his/her Story Entry, Photo Entry or Video Entry by means of any form of social media posting (e.g., on Facebook, on Twitter, etc.), then such Contest entrant must clearly indicate in such posting that his/her Entry is part of a contest submission.

BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT THE CONTEST ENTRY MAY BE POSTED (BUT IS NOT OBLIGATED TO BE POSTED) ON ONE OR MORE OF SPONSOR'S WEBSITES, IN SPONSOR'S SOLE DISCRETION. Posting of an Entry is not an indication that the Entry has won a prize or is otherwise eligible for a prize. Upon submission into the Contest, the Entry will become the property of Sponsor, and may be displayed, used or altered by Sponsor (or any party Sponsor authorizes) for any purpose, without any kind of payment or notice to the entrant. This also means that: (a) Sponsor, or any of its affiliates, may produce, market, sell, distribute, or otherwise exploit products and/or services based (in whole or in part) on the Entry; (b) the entrant irrevocably and in perpetuity grants and assigns to Sponsor all worldwide right, title, and interest in and to the Entry (and all works derived from the Entry) and in and to all intellectual property that such entrant creates by participating in the Contest; and (c) the entrant waives all rights of attribution and integrity if the Entry is used by Sponsor or anyone Sponsor authorizes.

Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to Contest entrants. Contest Administrator and Sponsor reserve the right, in their reasonable discretion, during or upon completion of the Promotion Period, to request that any entrant resubmit his/her Entry prior to any judging period. By submitting an Entry, entrant agrees that the Entry is gratuitous and made without restriction, that the Entry will not place Sponsor under any obligation, and that Sponsor is free to disclose, share or disseminate the ideas contained in the Entry on a non-confidential basis to anyone or otherwise to use and exploit these ideas without any additional compensation to entrant. Entrant acknowledges that, by acceptance of the Entry, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than entrant. Sponsor reserves the right to, but may or may not (in the exercise of its sole discretion), monitor/screen Entries prior to posting them to the Website.

    5. Public Voting: During the Promotion Period, individuals may vote on an Entry by visiting the online gallery at the Website and following the on-screen directions to vote (a "Vote"). The number of Votes received for each Entry at the conclusion of the Promotion Period will determine the Public Appeal/Voting score included in the "Judging Criteria" listed in Section 6 below. LIMIT OF ONE (1) VOTE ON A TOTAL OF ONE (1) ENTRY PER PERSON / EMAIL ADDRESS DURING EACH DAY OF THE PROMOTION PERIOD. Multiple votes received from any person or email address in excess of the stated number (on any such day) will be void. Any attempt by any entrant or voter to obtain more than the stated number of votes by any fraudulent or inappropriate means, including without limitation, by offering prizes or other inducements to members of the public, by using any automated program, by using multiple/different email addresses, identities, registrations and/or logins, or by any other methods, will void those votes, and in the sole discretion of Contest Administrator, the entrant engaging in such conduct, and/or any and all Entries submitted by such entrant, may be disqualified from any further participation or prize participation in the Contest. Contest Administrator reserves the right, in its sole discretion, to select one or more alternate prize winner(s) in the Contest if the voting in the Contest appears to have been tampered with or manipulated in any way.

    6. Winner Selection: All eligible Entries received during the Promotion Period will be judged by Sponsor and/or Sponsor's agents/designees (such applicable personnel, hereafter "the judges") based on the following criteria ("Judging Criteria"), each in the percentage weight that is indicated below:

      • Creativity– 25%
      • Originality – 25%
      • Persuasiveness – 30%
      • Public Appeal – 20%

One (1) Photo Grand Prize Winner - From among only the eligible Photo Entries received by Sponsor during the Promotion Period, the entrant whose Entry achieves the highest total score, across all Judging Criteria, shall be deemed the Photo Grand Prize Winner.

One (1) Story/Video Grand Prize Winner - From among only the eligible Story Entries and Video Entries received by Sponsor during the Promotion Period, the entrant whose Entry achieves the highest total score, across all Judging Criteria, shall be deemed the Story/Video Grand Prize Winner.

One (1) 2nd Prize Winner - From among all eligible Entries (i.e., Story Entries, Photo Entries and Video Entries) received by Sponsor during the Promotion Period, but after excluding the Entries which have been selected as the Photo Grand Prize Winner and the Story/Video Grand Prize Winner, the entrant whose Entry achieves the highest total score, across all Judging Criteria, shall be deemed the 2nd Prize Winner.

Three (3) 3rd Prize Winners - From among all eligible Entries (i.e., Story Entries, Photo Entries and Video Entries) received by Sponsor during the Promotion Period, but after excluding the Entries which have been selected as the Photo Grand Prize Winner, the Story/Video Grand Prize Winner and the 2nd Prize Winner, the three (3) entrants whose Entries achieve the next-highest total scores (i.e., after the 2nd Prize Winner) across all Judging Criteria, shall be deemed the three (3) 3rd Prize Winners.

In the event of a tie, at any prize level, the tying entries will be re-judged by the judges using the same Judging Criteria. If there is a subsequent tie, the tie will be broken on the basis of the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in the order listed above, as needed, until the tie is broken. In the event that a tie remains unbroken after factoring in the respective scores for each of the four (4) individual Judging Criteria, then the judges, in their sole discretion, may break the tie based on their comparative overall impression of the tying Entries. Prize winners will be determined on or about December 11, 2015.

    7. Prizes and Approximate Retail Values (“ARV”): Two (2) Grand Prize Winners (one for the Photo Grand Prize Winner, and one for the Story/Video Grand Prize Winner): $5,000 each; One (1) Second Prize Winner: $2,000; Three (3) Third Prize Winners: $600 each. Prizes shall be awarded in the form of a check, wire/electronic funds transfer, or a gift card, as determined in Sponsor's sole discretion. Total ARV of all prizes is $13,800. Use of gift cards is subject to all terms, conditions, restrictions and policies of the issuer, as such information is set forth or referenced on the gift card itself, on a website owned or operated by the issuer, or elsewhere as designated by the issuer. No substitution, exchange, return, cash redemption or transfer of any prize is permitted, except at Sponsor's sole discretion. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute a prize of equal or greater value. The prompt reporting and prompt payment of all federal, state and local taxes on the retail value of any prize, and all other costs associated with the acceptance or use of any prize, are the sole and full responsibility of the winner of such prize. A Form 1099 may be issued to each prize winner and to the U.S. Government. Arrangements for delivery of prizes will be performed after winner validation. LIMIT OF ONE (1) PRIZE PER PERSON/EMAIL ADDRESS/HOUSEHOLD; ONCE A PERSON/EMAIL ADDRESS/HOUSEHOLD HAS BEEN SELECTED TO RECEIVE A PARTICULAR PRIZE IN THE CONTEST, ANY AND ALL OTHER ENTRIES SUBMITTED BY THE SAME PERSON/EMAIL ADDRESS/HOUSEHOLD SHALL BECOME INELIGIBLE TO BE SELECTED FOR ANY OTHER PRIZE IN THE CONTEST, EVEN IF ANY SUCH OTHER ENTRY RECEIVES A SCORE (ACROSS ALL JUDGING CRITERIA) THAT OTHERWISE WOULD HAVE QUALIFIED SUCH ENTRY FOR A PRIZE PURSUANT TO SECTION 6 ABOVE . At Sponsor's discretion, unclaimed prizes may not be awarded.

    8. Conditions: Contest Administrator's decisions are final in all matters relating to this Contest. All potential winners (and/or their parent/legal guardian if a minor) will each be notified by telephone, email, regular mail or overnight mail and may be required to complete, sign and return an affidavit of eligibility, a liability release, and where lawful, a publicity release within a stated amount of time. If a potential prize winner cannot be reached within a reasonable time period (as determined solely by the Contest Administrator and/or Sponsor) after the initial attempted notification, or if declarations/releases are not received by the date stated on the notification, or if any notification is returned as non-deliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, or does not return such other releases as deemed necessary by Contest Administrator, then the potential prize winner will be disqualified and, at Contest Administrator's sole discretion, an alternate potential prize winner may be selected from among the remaining eligible Entries received by Sponsor during the Promotion Period, such selection to utilize the same Judging Criteria which are described in Section 6 above. Promotion Parties are not responsible for any change of email address, mailing address and/or telephone number of entrants. Promotion Parties assume no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged, garbled, indecipherable or incomplete entries or other communications, non-delivered or postage due mail, failure or unavailability of electronic equipment, communications or internet connections, or other errors, failures or malfunctions of any kind.
